Questions Arise for Newly-Married Same-Sex Homeowners

San Francisco Real EstateSame-sex married couples who own their homes can now change the way their property is deeded, holding it in a way that wasn’t available to them before the same-sex marriage became legal this month.

Whether they should make the change isn’t clear.

“It’s not a one-size-fits-all kind of situation. It depends on how they run their married financial life,” said Robin Bodiford, a Fort Lauderdale lawyer whose specialties include estate planning and real estate. Bodiford, who helped win passage of the Broward ordinance banning anti-gay discrimination, married Sandra Picardi the day same-sex marriage became legal in Florida.

What is certain is that the option of becoming “tenants by the entireties,” instead of “joint tenants with the rights of survivorship,” is now available, said Broward Property Appraiser Lori Parrish.
